1. Overview
These Terms of Service govern your use of the GGiT website and any services engaged through it. GGiT ("we", "us", "our") provides web design and development, site support, AI systems, automation, and commerce and marketing services to business clients. By submitting an enquiry or engaging a service you confirm you have read and agree to these terms.
2. Services
Services are provided as described on the GGiT website at the time of engagement. Each service has a defined scope. Work outside that scope , including additional pages, integrations, or features not specified at the start , is treated as a separate engagement and priced accordingly. GGiT reserves the right to decline any project at its discretion.
3. Engagements and Payment
All engagements begin with a review session to confirm scope, deliverables, and timeline. A deposit is required before any implementation work starts. The deposit amount and remaining balance structure are confirmed during the review session. Final deliverables are released upon receipt of full payment. Deposits are non-refundable once scoping work has begun.
Prices listed on the website are starting prices and represent the minimum for that service category. Final pricing depends on scope confirmed during the review session. GGiT is not obligated to deliver at a listed price if the confirmed scope exceeds what that price covers.
Recurring services , including support retainers, managed hosting, maintenance, and similar monthly services , are billed on an ongoing basis as agreed at the start of the engagement. Unless otherwise stated in writing, monthly services renew until canceled with reasonable notice. Third-party platform, software, domain, email, hosting, API, payment processor, or app subscription fees are separate from GGiT service fees unless explicitly included in the agreement.
4. Client Responsibilities
Clients are responsible for providing accurate information, timely feedback, necessary access (domain registrars, hosting accounts, third-party platforms), and any content or assets required for delivery. Delays caused by the client may affect timelines and do not constitute a breach by GGiT. GGiT is not responsible for third-party platform outages, policy changes, or restrictions that affect deliverables.
5. Deliverables and Intellectual Property
Upon receipt of full payment, the client owns the deliverables produced specifically for their project , including website design, written content created for them, and custom code written for their project. GGiT retains ownership of any proprietary frameworks, tools, processes, or templates used in delivery. GGiT may reference the client's project in its own portfolio unless the client requests otherwise in writing before project close.
The client represents that any materials, images, or content provided to GGiT are owned by them or properly licensed, and that their use does not infringe any third-party rights. The client indemnifies GGiT against any claims arising from client-provided content.
6. Limitation of Liability
GGiT's liability under any engagement is limited to the amount paid by the client for that engagement. GGiT is not liable for indirect, consequential, or incidental losses , including loss of revenue, customers, data, or business opportunity , arising from any service, deliverable, or system provided. GGiT makes no guarantees regarding search engine rankings, advertising performance, conversion rates, or revenue outcomes resulting from any service.
7. Acceptable Use
Services may not be used to create, distribute, or support content or systems that are unlawful, fraudulent, defamatory, or harmful. GGiT reserves the right to refuse or terminate an engagement if the intended use violates these terms or is otherwise inconsistent with GGiT's values.
8. Modifications
GGiT may update these terms at any time. The current version is always posted on this page with the effective date. Continued use of GGiT services after an update constitutes acceptance of the revised terms.
9. Governing Law
These terms are governed by the laws of the jurisdiction in which GGiT operates. Any disputes that cannot be resolved informally will be subject to binding arbitration before any court proceedings, except where prohibited by law.
10. Contact
Questions about these terms can be directed through the contact form on this website or via the email address listed in the contact section.
